A Public Service Regulatory Notification on People Investigations in BC |
The government of the Province of BC mandates that people and entities doing people investigations must use qualified and licensed private investigators. Both the person and the company hired must be licensed. This includes HR personnel, IT security people, cyber security people, etc. Please check with the Ministry for your particular circumstances.
"Our opinion" on inside corporate investigations is that they should be done by a third party that is arms length from the company and done in conjunction with an independant lawyer. Any lawyer will tell you that.

The Act and the interpretation is in a standard format. It must be read in the context of the what is contained in the "Definitions" section. Key examples below;
"property" means real and personal property and includes information and data;
"private investigator" means a person who, for consideration, seeks or obtains information about any of the following:
(a) crimes, offences, contraventions or misconduct, or allegations of crimes, offences, contraventions or misconduct;
(b) the activities, character or repute of a person or organization;
(c) the whereabouts of a person;
(d) the location, disposition or recovery of lost, stolen or missing property;
(e) the cause of or the responsibility for any fire, accident or incident in which damage to property or injury to any person has occurred;
Our research shows that many law firms, corporate executives, human resources departments, insurance companies, cyber security companies, and indeed many of our competitors, are unaware of these regulations. The Act was introduced in the interest of public safety and using unlicensed and unqualified individuals could introduce serious risks.
